Nationwide Mutual Insurance Company Class Action Dismissed



Clients tried to file a class action against the insurance company challenging the validity of the household / family exclusion in auto policies. Plaintiffs have agreed to dismiss their cause of action against the defendant with prejudice. The dismissal was based on a decision by the Tennessee Supreme Court answering a certified question from the federal district court. The court held that the challenged household or family exclusion was valid, enforceable was valid and not against the public policy of Tennessee. (Dec-09-05)
