Department of Justice, US Navy

Washington, DC: (May-15-07) More than 3,400 property owners in Virginia Beach and Chesapeake, VA, have filed a class action lawsuit against the Justice Department and the US Navy, over jet noise at a naval air base. The suit stemmed from the relocation of 156 Navy F/A-18 C/D Hornet fighter jets from Cecil Field, FL, to Naval Air Station Oceana in Virginia Beach, VA, between December 1998 and July 1999. Plaintiffs own approximately 2,100 properties and alleged in a group of nine lawsuits filed between April 2001 and June 2005, that the introduction of the Hornets resulted in a substantial increase in overflights and jet noise. Though a trial was set in motion, both parties agreed to settle, avoiding the costs and uncertainties of litigation. Under the settlement reached, the federal government agreed to pay the plaintiffs an amount not to exceed $34.4 million. A large majority of the participating plaintiffs also agreed to grant the United States a permanent easement over their properties to accommodate existing and additional future naval aircraft operations. I live in the Shadowlawn area of Virginia Beach and the jets come right over our house. When that jet crashed a couple years ago it was less then a mile and a half away.
My neighbor received a payoff in that class action suit and I have never received any info on it. This house has been in the family since 1969, I have owned it since 2006.
Is it to late to file for compensation?

I live on lake Havasu drive 23454. I need to find out how do I qualify also. In event we don't, I think it's enough of us to file another lawsuit, because I didn't receive nothing.

please. They regularly fly <200'AGL @ +130db dumping exhaust and unspent fuel over our homes. There is nothing to do but wait until they kill one of us. If they only did their circuit work over the ocean and came in at a normal approach, all would be fine. My suggestion...move. If you can't, like me, buy a DVR so you can pause your tv. Get some migraine meds, and stop complaining because the city won't do anything and according to the FAA regs, there is nothing we can do because no rules exists when the military takes of and lands.

I have suffered 20 percent hearing loss due to being employed by and living near Naval Air Station Oceana, hearing loss not age related, cosistent with loud noise. Jet noise exceeds the 140 dcbl level mulitplied by 5 jets taking off and landing in quick succession for up to an hour at a time, no protective hearing gear was provided to support staff on Base, Homeowners were paid a $34 million payoff, employees are being blown off for their work related injuries.
