Petroleum Leak



Elkhart, IN: (Jan-09-08) A class action lawsuit was filed against 7-Eleven, Southland, MDK and ENSR Corporation, over the release of petroleum from a gas station at 1000 South Main Street in Goshen, Indiana. The suit claimed that the defendants were responsible for the leak that occurred from underground storage tanks at the gas station. It stated that the petroleum releases allegedly entered the groundwater and soil in the neighborhood around the gas station and petroleum vapors also allegedly entered into surrounding properties. Plaintiffs alleged that the companies failed to notify residents of the incident.

As part of a settlement reached, the defendants agreed to pay $19.8 million towards payments and site investigation and remediation expenditures. The class entitled to the payout would include all current and former owners, renters and occupants of certain properties and houses in the Jackson Street Neighborhood from January 1, 1996 to December 11, 2007. The settlement ends all litigation that was pending in the Elkhart Superior court. [CENTRE DAILY: GAS LEAK]
