Shareholders tried to file a class action derivative lawsuit against the pharmaceutical company and certain current and former directors and officers to join a previously pending case. The Superior Court for the County of Orange in the State of North Carolina has dismissed the class action in its entirety with prejudice. The related class action lawsuit filed in the U.S. District Court for the Middle District of North Carolina is ongoing. (Nov-14-05)
